INFORMATIVA PER IL TRATTAMENTO DEI DATI PERSONALI

Ai sensi dell’art. 13 del Regolamento (UE) 2016/679 (R.G.P.D. o nell’accezione inglese G.D.P.R. General Data Protection Regulation) sulla protezione dei dati personali ed in relazione ai suoi dati personali il loro trattamento verrà improntato da Digital Promoter S.R.L. ai principi di correttezza, liceità e trasparenza, nonché di tutela della Sua riservatezza e di tutela dei Suoi diritti. In relazione a ciò La informiamo di quanto segue.

TIPOLOGIA DI DATI PERSONALI

Raccoglieremo i seguenti dati personali quando interagite con il Sito:

· Dati personali identificativi (ad es. il vostro nome, cognome, indirizzo, luogo e data di nascita, telefono, l’indirizzo e-mail).

· Raccoglieremo inoltre dati personali in modo automatico quando interagite con il Sito attraverso il vostro computer, i vostri dispositivi mobili o altri dispositivi (quali ad esempio nomi di dominio, indirizzi IP, sistema operativo utilizzato, tipo di device, di browser utilizzati per la connessione, l’orario della richiesta)

· Dati sulle preferenze dell’Utente manifestate in relazione od in occasione di determinai acquisti

FINALITÀ E BASE GIURIDICA DEL TRATTAMENTO

Il trattamento a cui saranno sottoposti i Suoi dati personali, raccolti al momento dell’iscrizione al sito web riconducibile al Titolare del trattamento, nonché durante l’utilizzo dei servizi resi, quali il servizio di acquisto ed emissione biglietti, riconducibili esclusivamente al domino https://www.ticketnation.it sarà effettuato per le finalità sotto indicate.

La base giuridica per il trattamento dei dati personali relativi a ciascuna finalità è specificata a fianco di ognuna di esse. Quando è indicato il consenso come base giuridica del trattamento, è inteso che i dati verranno trattati dal Titolare per tali finalità solo previa raccolta del Suo consenso (in qualità di “interessato”). La base giuridica concernente l’esecuzione del contratto non richiede alcun consenso e consente al titolare di trattare i dati personali conferiti in base agli obblighi contrattuali assunti (es. rendere un servizio o vendere un prodotto). Infine, per quanto riguarda i legittimi interessi indicati, essi riguardano il caso in cui:

a) l’interessato ha già manifestato interesse per il settore merceologico in questione, acquistando determinati prodotti o servizi, ed il Titolare ha un interesse specifico e giustificato a continuare a inviargli comunicazioni in relazione in relazione a servizi analoghi a quelli acquistati precedentemente,

b) il titolare ha interesse a trattare i dati di navigazione dell’interessato al fine di consentirgli la visita delle pagine web.

c) gestione organizzativa dell’evento acquistato o di servizi correlati (es. informare in merito a eventuali annullamenti o rinvii di data dell’evento acquistato, come accedere o partecipare all’evento, come procedere a chiedere il rimborso in caso di cancellazione dell’evento);

I Suoi dati personali saranno trattati per le seguenti finalità̀:

invio per finalità di marketing - tramite posta elettronica con sistemi automatizzati- di materiale pubblicitario relativo, offerte, promozioni, sconti e inviti a eventi di TicketNation . (Base giuridica del trattamento: Consenso dell’interessato);
invio, esclusivamente all’indirizzo di posta elettronica da Lei fornito durante l’acquisto di un servizio dal Sito web, di messaggi promozionali su servizi analoghi a quelli da Lei acquistati, sempre che non si opponga al trattamento con le modalità di seguito indicate, secondo quanto previsto dall’art. 140, comma 4, del D. Lgs. n. 196/2003 e successive modifiche ed integrazioni – c.d. soft spam. (Base giuridica del trattamento: interesse legittimo);
per consentire la navigazione sui Siti web. (Base giuridica del trattamento: interesse legittimo).
adempimento di obblighi derivanti dalla legge o dai regolamenti, nazionali e/o comunitari, in vigore, in particolare, in ambito fiscale, nonché di pubblica sicurezza e in materia di "secondary ticketing", nonché da disposizioni impartite da autorità ed enti competenti. difesa in giudizio del Titolare di un diritto od interesse dinanzi a qualunque autorità od ente competente, ivi espressamente incluso ai fini del recupero del credito. (Base giuridica del trattamento: interesse legittimo).

FACOLTÀ O OBBLIGO DEL CONFERIMENTO E CONSEGUENZE DEL MANCATO CONFERIMENTO DEI DATI

Per le finalità di cui ai punti 1), 3) il conferimento dei dati personali è meramente facoltativo, tuttavia l’eventuale mancato, parziale o inesatto conferimento comporterebbe l’impossibilità per l’interessato di registrarsi al sito e di usufruire dei servizi on-line offerti da TicketNation, quali il servizio di ticketing, nonché dare adempimento agli obblighi di legge, perseguimento di un legittimo interesse del Titolare, dare esecuzione al contratto instaurando o instaurato ed evadere le eventuali richieste pervenute.

Per le finalità di cui ai punti 4) il conferimento dei dati personali è meramente facoltativo e il relativo trattamento si basa sul consenso, il quale è informato, preventivo, libero e revocabile in qualsiasi momento. L’eventuale mancato conferimento non comporterà alcuna conseguenza sulla possibilità di registrarsi al Sito e di usufruire dei servizi offerti da TicketNation, ivi inclusa la possibilità di effettuare acquisti sullo stesso. Il consenso può essere revocato in ogni momento, tramite l’area privata del profilo utente.

DESTINATARI O CATEGORIE DI DESTINATARI DEI DATI PERSONALI

I dati personali relativi al trattamento in questione, per le finalità̀ di cui sopra, potranno essere comunicati:

- a coloro i quali all’interno dell’organizzazione del Titolare, ne abbiano necessità per effetto della mansione ricoperta. Tali soggetti sono le persone autorizzate al trattamento sotto l’autorità diretta del Titolare ai sensi dell’art. 4 n. 10 del Regolamento UE 2016/679 (di seguito “incaricati”).

- ai soggetti la cui attività è necessaria per l’esecuzione dei contratti di cui Lei è parte o per adempiere a specifiche richieste (es: Trasportatori, Società ed istituti del settore bancario

tramite i quali vengono effettuati i pagamenti on line dei prodotti acquistati tramite il Sito, creditizio e assicurativo ecc.);

- a soggetti terzi a cui il Titolare eventualmente esternalizza talune attività e che di conseguenza erogano alla scrivente determinati servizi strumentali, comunque correlati ai trattamenti e alle finalità̀ sopra descritte, quali ad esempio servizi amministrativi, contabili, fiscali, di revisione, di manutenzione, società che si occupano dell’aggiornamento e gestione degli hardware e software del Titolare del trattamento ovvero altre società di cui si serve il Titolare del trattamento per l’erogazione dei propri servizi. Tali soggetti terzi effettuano trattamenti per conto del Titolare e risultano autorizzati a trattarli in qualità̀ di Responsabili del trattamento secondo quanto previsto dall’art 28 del GDPR. Un elenco nominativo e aggiornato dei soggetti nominati quali responsabili del trattamento è disponibile presso la sede del Titolare del trattamento.

- a tutti quei soggetti che hanno accesso ai dati personali in forza di provvedimenti normativi o amministrativi o qualora la comunicazione sia necessaria per l’adempimento degli obblighi contrattuali assunti, nonché degli obblighi derivanti dalla legge;

- a società terze i cui servizi vengono proposti o venduti tramite il Sito web e, in particolare, a società o enti organizzatori di concerti, spettacoli, eventi sportivi o di altro tipo i cui biglietti sono venduti tramite il Sito), limitatamente alla gestione e verifica degli ingressi e dei titoli di ingresso agli eventi;

TRASFERIMENTO DI DATI PERSONALI

In ogni caso i dati personali di non saranno trasferiti verso Paesi extra-UE o al di fuori dello Spazio Economico Europeo.

PERIODO DI CONSERVAZIONE

I dati saranno trattati per tutto il tempo necessario allo svolgimento del rapporto contrattuale in essere e per i successivi dieci anni dalla data di acquisizione degli stessi. Per le finalità̀ di marketing il dato di acquisto verrà conservato per 24 mesi, mentre per finalità di profilazione si conserveranno per un periodo di 12 mesi.

Nel caso di cancellazione, esclusione o disabilitazione per mancato utilizzo del Suo account sul Sito, i Suoi dati saranno conservati per finalità amministrative per un periodo non superiore ad un trimestre, fatti salvi eventuali specifici obblighi di legge sulla conservazione di documentazione contabile o per finalità di pubblica sicurezza. In tali casi, sarà garantita la cancellazione dei dati anche da parte dei responsabili nominati cui gli stessi siano stati eventualmente comunicati.

MINORI DI ANNI 16

I Servizi offerti dal Titolare del trattamento nel Sito non contengono informazioni né funzionalità o servizi direttamente destinati a utenti di età inferiore a 16 anni. I minori non devono conferire informazioni o dati personali in assenza del consenso degli esercenti la responsabilità genitoriale su di loro.

Il Titolare invita, dunque, tutti gli utenti che non abbiano compiuto 16 anni a non comunicare in nessun caso i propri dati personali senza la previa autorizzazione di un genitore o dell’esercente la responsabilità genitoriale. Qualora il Titolare venisse a conoscenza del fatto che i dati personali sono stati forniti da persona minore di età (minore di anni 16), il Titolare stesso provvederà alla distruzione degli stessi o a chiedere la trasmissione di apposito consenso da parte dei genitori (o dell’esercente la responsabilità genitoriale), riservandosi altresì la facoltà di inibire l’accesso ai servizi disponibili sul Sito a qualsiasi utente che abbia celato la propria minore età o che abbia comunque comunicato i propri dati personali in assenza del consenso dei propri genitori (o dell’esercente la responsabilità genitoriale).

I SUOI DIRITTI

In ogni momento ai sensi del Regolamento europeo 679/2016 (GDPR) e della normativa nazionale in vigore, l'interessato può, secondo le modalità e nei limiti previsti dalla vigente normativa, esercitare i seguenti diritti ai sensi degli articoli dal 15 al 22 del predetto Regolamento:

a) chiedere la conferma dell’esistenza o meno di propri dati personali;

b) ottenere le indicazioni circa le finalità del trattamento, le categorie dei dati personali, i destinatari o le categorie di destinatari a cui i dati personali sono stati o saranno comunicati e il periodo o criterio di conservazione;

c) ottenere la rettifica e la cancellazione dei dati;

d) ottenere la limitazione del trattamento;

e) ottenere la portabilità dei dati, ossia riceverli da un titolare del trattamento, in un formato strutturato, di uso comune e leggibile da dispositivo automatico, e trasmetterli ad un altro titolare del trattamento senza impedimenti;

f) opporsi al trattamento dei Suoi dati personali in qualsiasi momento (art. 21). In particolare potrà opporsi al trattamento dei Suoi dati per la finalità di cui al punto “n.5” (c.d soft spam) accedendo alla propria "Area Riservata" o selezionando il link presente su ogni e-mail inviata da da Digital Promoter S.R.L. Ciò comporterà l’impossibilità per il Titolare di inviarle comunicazioni al fine di promuovere la vendita diretta di prodotti o servizi analoghi a quelli da Lei acquistati precedentemente (cd. soft spamming).

g) opporsi ad un processo decisionale automatizzato, compresa la profilazione (art.22);

h) revocare il consenso in qualsiasi momento senza pregiudicare la liceità del trattamento basata sul consenso prestato prima della revoca;

i) proporre reclamo all’Autorità Garante della protezione dei dati (art.77 GDPR e art. 140 bis D. Lgs. 196/2003) qualora ritenga che il trattamento dei suoi dati sia contrario alla normativa in vigore.

PURPOSE AND LEGAL BASIS OF THE PROCESSING

The processing to which your personal data will be subjected, collected at the time of registration on the website attributable to the Data Controller, as well as during the use of the services rendered, such as the purchase and ticketing service, exclusively attributable to the https domain: //www.ticketnation.it will be carried out for the purposes indicated below.

The legal basis for the processing of personal data relating to each purpose is specified alongside each of them. When consent is indicated as the legal basis of the processing, it is understood that the data will be processed by the Data Controller for these purposes only after obtaining your consent (as an "interested party"). RIGHT OR OBLIGATION TO PROVIDE AND CONSEQUENCES OF FAILURE TO PROVIDE DATA

For the purposes referred to in points 1), 3) the provision of personal data is purely optional, however any failure, partial or incorrect provision would make it impossible for the interested party to register on the site and use the online services. line offered by TicketNation, such as the ticketing service, as well as fulfilling legal obligations, pursuing a legitimate interest of the Data Controller, executing the contract by establishing or establishing and fulfilling any requests received.

For the purposes referred to in points 4) the provision of personal data is purely optional and the related processing is based on consent, which is informed, preventive, free and revocable at any time. RECIPIENTS OR CATEGORIES OF RECIPIENTS OF PERSONAL DATA

The personal data relating to the processing in question, for the aforementioned purposes, may be disclosed:

- to those who, within the organization of the owner, need it as a result of the position held. These subjects are the persons authorized to process under the direct authority of the Data Controller pursuant to art. 4 n. 10 of EU Regulation 2016/679 (hereinafter "appointees").

- to the subjects whose activity is necessary for the execution of the contracts of which you are a party or to fulfill specific requests (eg: Transporters, Companies and institutions in the banking sector through which the online payments of the products purchased through the Site, credit and insurance etc.);

- to third-party companies whose services are offered or sold through the Website and, in particular, to companies or organizations organizing concerts, shows, sporting or other events whose tickets are sold through the Website), limited to the management and verification of admissions and admission tickets to events;

TRANSFER OF PERSONAL DATA

In any case, personal data will not be transferred to non-EU countries or outside the European Economic Area.

STORAGE PERIOD

The data will be processed for as long as necessary to carry out the existing contractual relationship and for the next ten years from the date of acquisition of the same. For marketing purposes, the purchase data will be kept for 24 months, while for profiling purposes they will be kept for a period of 12 months.

In the event of cancellation, exclusion or disabling due to non-use of your account on the Site, your data will be kept for administrative purposes for a period not exceeding one quarter, without prejudice to any specific legal obligations on the conservation of accounting documentation or for the purpose of public security. In such cases, the deletion of the data will also be guaranteed by the appointed managers to whom they may have been communicated.

MINORS UNDER 16 YEARS

The Services offered by the Data Controller on the Site do not contain information or functionality or services directly intended for users under the age of 16. Minors must not provide information or personal data in the absence of the consent of the exercisers of parental responsibility over them.

The Data Controller therefore invites all users who are under the age of 16 not to communicate their personal data under any circumstances without the prior authorization of a parent or parental responsibility operator. c) obtain the rectification and cancellation of data;

d) obtain the limitation of the processing;

e) obtain data portability, i.e. receive them from a data controller, in a structured format, commonly used and readable by an automatic device, and transmit them to another data controller without hindrance;

f) oppose the processing of your personal data at any time (Article 21). In particular, you may object to the processing of your data for the purposes referred to in point "n.5" (so-called soft spam) by accessing your "Reserved Area" or by selecting the link on each e-mail sent by by Digital Promoter S.R.L. This will make it impossible for the Owner to send you communications in order to promote the direct sale of products or services similar to those you previously purchased (so-called soft spamming).

h) withdraw the consent at any time without prejudice to the lawfulness of the processing based on the consent given before the revocation;

i) to lodge a complaint with the Data Protection Authority (Article 77 of the GDPR and Article 140 bis of Legislative Decree 196/2003) if it considers that the processing of your data is contrary to the legislation in force.
